Terms and Conditions

These terms govern your use of OfferBank OS (the “Services”), developed and sold by DKL Software. By purchasing or using the Services you agree to them. If you do not agree, do not use the Services.

1. Your account

An account is created for you after purchase. You are responsible for keeping your password private and for everything done under your account. Provide accurate information and tell us about any unauthorised use.

2. Acceptable use

Use the Services only for lawful marketing of products you are permitted to promote. You must not:

• Send unsolicited email, or email anyone who has unsubscribed
• Publish content that is false, defamatory, infringing or that makes claims the promoted product does not support
• Collect or use lead data in breach of the privacy or anti-spam law that applies to you
• Attempt to access other users' data, disrupt the service, or resell access outside the Reseller and Agency features
• Use the hosted pages for anything other than promotion of the offers in your campaigns

We may suspend or close accounts that break these terms, and take down pages that do.

3. Generated content

The Services write content with AI from the pages and information you supply. Output can be inaccurate, incomplete or unsuitable. You review everything before you publish or send it, you are responsible for its accuracy and for the claims it makes, and you are the publisher of the pages and emails that carry it.

4. Your content and licence

You own what you enter and what the Services generate for you. You grant us the licence needed to store, process, host and serve it as part of the Services. We may remove content that breaks these terms or the law.

5. Credits

Features that use AI spend credits from your balance at the cost of the model time actually used; the typical cost is shown before each action. Credits have no cash value, are not transferable and are not refunded except under the Refund Policy. A generation that fails is not charged.

6. Hosted pages and addresses

Pages are hosted under an address on our domain that you choose, or under a domain you connect. Addresses are provided while your account is in good standing; we may reclaim an address that is misleading, infringing or unused. Keep exports of anything you need to keep.

7. Third-party platforms

The offers you promote, the affiliate networks that pay you, the social platforms you post to and the mail provider you connect are governed by their own terms. We are not responsible for their availability, policies or decisions, including refused or reversed commissions.

8. Payments

Purchases are made through LaunchPad, which processes payment and applies its own terms. Prices may change; changes never apply to what you already bought.

9. Intellectual property

The software, design, templates and brand are owned by DKL Software or its licensors. You may not copy, reverse engineer or resell them except as the Reseller, Agency and WhiteLabel features expressly allow.

10. Availability

We aim to keep the Services available but do not promise uninterrupted access. Maintenance, provider outages and abuse controls can interrupt them. The Services are provided as is and as available.

11. Limitation of liability

To the extent the law allows, DKL Software is not liable for indirect, incidental or consequential loss, lost profits or commissions, lost data, or for the content of pages and emails you publish. Our total liability for any claim is limited to what you paid for the Services in the twelve months before the claim.

12. Termination

You may stop using the Services at any time. We may suspend or end access for breach of these terms, where the law requires, or to protect the Services and other users. Sections 3, 4, 9 and 11 survive termination.

13. Changes

We may update these terms. Continued use after an update is acceptance of it; material changes are announced to account holders.

14. Governing law

These terms are governed by the laws of Vietnam, without regard to conflict-of-law rules.
